Welcome to the American Geophysical Union’s (AGU) Fall Meeting Community

AGU’s Fall Meeting Community (also referred to as the “Site” or “Community”) is part of the American Geophysical Union (also referred to as “AGU”, “we”, “us” or “our”). Anyone may register on the Site. While AGU will take all reasonable measures to keep information and users (also referred to as “they”, “you” or “your”) safe, we do not control or direct users’ actions and are not responsible for the information users transmit or share on the Site (also referred to as “Content”). Users of the Site acknowledge and accept that AGU is not responsible for the conduct, whether online or offline, or any user of the Community, and they agree to hold AGU harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs).

By using or accessing the AGU Fall Meeting Community, you agree to this Statement and any subsequent updates.

Terms that Govern the Use of the AGU Fall Meeting Community.

Please read these Terms of Use (also referred to as the “Statement”) carefully as they govern our mutual rights and responsibilities when you use the resources and services provided by AGU through the AGU Fall Meeting Community. These Terms apply to all activities and modalities on the Site, including but not limited to, profiles, forums, groups, comments, chats, and member-to-member messages within the Community. AGU reserves the right to change, at any time, at our sole discretion, these Terms. You are responsible for regularly reviewing these Terms. Your continued use of the Site constitutes your agreement to all of these Terms.

If you are a registered user, when you check the “I Accept Terms of Use” box, you signify that you have read, understand, and agree to these Terms. If you are a non-registered “public” user, accessing the Site signifies that you have read, understand, and agree to these Terms. If you do not agree to these Terms, you are not authorized to use the Site.

Unless otherwise agreed to, you are subject to these Terms, and any additional terms that may apply. These additional terms, if any, will be available through the Site. Collectively, these terms create a legal agreement between you and AGU. If any portion of this Statement is found to be unenforceable, the remaining portion will remain in full force and effect. If we fail to enforce any of this Statement, it will not be considered a waiver. Any amendment to or waiver of this Statement must be made in writing and signed by us. You will not transfer any of your rights or obligations under this Statement to anyone else without our consent. Nothing in this Statement shall prevent us from complying with the law. We reserve all rights not expressly granted to you. You will comply with all applicable laws when using or accessing the AGU Fall Meeting Community.

1. Rights and Obligations Related to Content and Material.

The Site and its Contents are protected by copyright pursuant to U.S. and international copyright laws.

a. Your Responsibilities.

If you create or operate a group, forum, comment on a forum, post material or links to any part of the Site, or otherwise make material available by means of the Site , you are responsible for the Content and any harm resulting from it.

You warrant and represent that you either own or otherwise control all of the rights to Content you provide to the Site, including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Content, or that your use of the Content is a protected fair use. You warrant and represent also that the Content does not violate these Terms and that you will indemnify and hold harmless AGU from any claims arising from Content you provide.

You may not copy, distribute, transmit, publicly display, publicly perform, participate in the transfer or sale of, create new works from, or in any way exploit, any of the Content on the Site in whole or in part in any manner.

You agree not to use the AGU Fall Meeting Community for commercial purposes or financial gain.

b. License to AGU.

By posting Content on this Site, you are granting AGU a nonexclusive, royalty free, perpetual, and worldwide license to use the Content on the Site until you remove or delete it, including but not limited to, the right to copy, distribute, transmit, publicly display, publicly perform, edit, translate, and reformat the Content, and/or to incorporate it into a collective work.

If you delete Content, AGU will use reasonable efforts to remove it from the Site, but you acknowledge that caching or references to the Content may not be made immediately unavailable.

Whenever possible, we will credit you as an author, and by posting Content on the Site you agree to give AGU the right to use your name for attribution purposes.

c. License to Site Users.

Unless you specify otherwise, all Content you submit to the Site is submitted under the terms and conditions of a Creative Commons Attribution NonCommercial Share Alike 3.0 license, or any successor or equivalent Creative Commons license. Under the terms of this license, you permit anyone to copy, distribute, transmit and adapt your Content, royalty-free, for non-commercial purposes on the condition that they credit your authorship each time they do so. You also permit others to distribute derivative works of your Content, but only if they do so under the same Attribution Non-Commercial ShareAlike license that governs your Content. d. Trademark Rights.

“American Geophysical Union”, “AGU”, and “AGU Fall Meeting Community” are the property of AGU and AGU retains all applicable trademark rights. You may not use any AGU name or logo to endorse or promote any product, opinion, cause or political candidate. Representation of your personal opinions as institutionally endorsed by AGU is strictly prohibited.

2. Code of Conduct

– You will not post unauthorized commercial communications (such as spam).

– You will not collect users’ content or information, or otherwise access the AGU Fall Meeting Community, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our prior permission.

– You will not upload viruses or other malicious code.

– You will not solicit login information or access an account belonging to someone else.

– You will not publish other people’s personal information.

– You will not bully, intimidate, or harass any user.

– You will not post content that: is hate speech, threatening, or pornographic; incites violence; or contains nudity or graphic or gratuitous violence.

– You will not use the AGU Fall Meeting Community to do anything unlawful, misleading, malicious, or discriminatory.

– You will not facilitate or encourage any violations of this Statement or our policies.

– You will not post content or take any action on the AGU Fall Meeting Community that infringes or violates someone else’s rights or otherwise violates the law.

– AGU reserves the right to remove any content or information you post on the Site if we believe that it violates this Statement or our policies.

– If you repeatedly infringe other people’s intellectual property rights, we will disable your account.

– You will not post anyone’s identification documents or sensitive financial information on the Site.

3. The AGU Roommate Forum

The AGU Fall Meeting Community includes a Roommate Forum, which is an electronic forum designed to facilitate communication among students seeking to share lodging during AGU’s annual Fall Meeting.

Users of the Roommate Forum acknowledge and accept that AGU is not acting as intermediary between interested parties and that we assume no responsibility for any arrangements made by those who post queries or those who respond to them. They acknowledge and accept that AGU is not responsible for screening roommates in any manner or financial arrangements between roommates or between roommates and the hotel or other lodging establishment. AGU makes no guarantees of any kind relating to a user’s ability to find or secure a suitable roommate and/or lodging arrangement.

Users of the Roommate Forum agree to provide truthful and accurate information regarding their name, travel dates, contact information, gender, and room preferences (such as smoking or non-smoking). They acknowledge and accept that, while AGU does provide rules for user conduct, we do not control or direct users’ actions and are not responsible for the content or information users transmit or share on the Site. Users of the Roommate Forum acknowledge and accept that AGU is not responsible for the conduct, whether online or offline, or any user of the Community. Users of the Roommate Forum agree to hold AGU harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs).

4. Removing Content, Discontinuing/Terminating Service, and Reporting Violations.

a. Removing Content

AGU has the right (though not the obligation) in their sole discretion to refuse or remove any Content at any time that violates these Terms or any AGU policy, or applicable federal or state statutes, or common laws.

b. Termination

AGU may at any time terminate its legal agreement with you and your right to access and use the Site if you have breached any provision of the Terms, AGU is required to do so by law, or AGU no longer maintains the Site and is terminating the service.

AGU also reserves the right to modify, suspend or discontinue the Site, with or without notice, at any time and without any liability to Site users.

c. Reporting Violations or Concerns.

If you have reason to believe that any Content or activity on this Site violates these Terms or is illegal or inappropriate, or to report any other abusive behavior in connection with the Site, please contact us by email at fm-help@agu.org or write to: Mirelle Argaman, Marketing Specialist, AGU, 2000 Florida Ave. NW, Washington, DC 20009.  If you do not include an electronic signature with your claim, we may ask you to submit a signed paper copy.

5. Disputes

You agree that if AGU does not exercise or enforce any legal right or remedy that is contained in these Terms (or for which AGU is entitled under any applicable law), this will not be taken to be a formal waiver of these rights and remedies.

If anyone brings a claim against AGU related to your actions, content or information on the AGU Fall Meeting Community, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim. Although we provide rules for user conduct, we do not control or direct users’ actions and are not responsible for the content or information users transmit or share on the Site. We are not responsible for any offensive, inappropriate, obscene, unlawful or otherwise objectionable content or information you may encounter on the Site. We are not responsible for the conduct, whether online or offline, or any user of the Community.

These Terms, and your relationship with the AGU Fall Meeting Community, shall be governed by the rules, regulations, and policies of AGU, and the District of Columbia without regard to its conflict of laws provisions. You and AGU agree to submit to the exclusive jurisdiction of the courts located within the District of Columbia to resolve any legal matter arising from these Terms. However, you agree that AGU shall still be allowed to apply for injunctive remedies (or any equivalent type of urgent legal relief) in any jurisdiction.

6. No Warranties and Disclaimer of Liability.

The posts, comments, and other Content on the Site are the views and opinions of their authors. Content is the sole responsibility of its authors. AGU does not verify or guarantee that the information presented on the Site is accurate or complete and AGU shall not be liable for any harm or damages arising from Content posted on the Site. The Site is provided on an “as is” and “as available” basis. AGU makes no representations or warranties of any kind, express or implied, regarding the availability, operation, or administration of the Site or the information or Content on it. AGU will not be liable for any damages of any kind arising from the use or inability to use the Site. You expressly agree that you use the Site solely at your own risk.
